Terms of Service

Welcome to RecDek. These Terms of Service (“Terms”) govern your use of the RecDek mobile application and website (collectively, the “Service”) operated by RecDek Ltd (“Company”, “we”, “us”, or “our”).

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

1. DESCRIPTION OF SERVICE

RecDek is a personal entertainment companion application that allows users to discover, track, and share films and TV shows. Our Service enables you to:

  • Create and manage personal watchlists
  • Track films and TV shows you have watched
  • Discover new content based on your preferences
  • Share recommendations with friends
  • Rate and review entertainment content
  • Connect with other users who share similar interests

2. USER ACCOUNTS

To access certain features of the Service, you must register for an account. When you create an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorised use of your account

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

3. USER CONDUCT

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others, including intellectual property rights
  • Harass, abuse, or harm another person or group
  • Post false, misleading, or defamatory content
  • Upload viruses, malware, or other malicious code
  • Attempt to gain unauthorised access to our systems or other users' accounts
  • Use the Service for any commercial purposes without our consent
  • Scrape, data mine, or use automated systems to access the Service
  • Interfere with or disrupt the Service or its servers

4. USER-GENERATED CONTENT

Our Service allows you to post, link, store, share, and otherwise make available certain information, text, graphics, or other material (“User Content”). You retain ownership of any User Content you submit, post, or display on or through the Service.

By posting User Content, you grant us a non-exclusive, worldwide, royalty-free, sublicensable, and transferable licence to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with operating and providing the Service.

You represent and warrant that you own or have the necessary rights to post your User Content, and that your User Content does not violate the rights of any third party.

5. INTELLECTUAL PROPERTY

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of RecDek Ltd and its licensors. The Service is protected by copyright, trademark, and other laws of the United Kingdom and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of RecDek Ltd.

6. THIRD-PARTY LINKS

Our Service may contain links to third-party websites or services that are not owned or controlled by RecDek Ltd. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

You acknowledge and agree that RecDek Ltd shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

7. DISCLAIMERS

The Service is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

RecDek Ltd does not warrant that: (a) the Service will function uninterrupted, secure, or available at any particular time or location; (b) any errors or defects will be corrected; (c) the Service is free of viruses or other harmful components; or (d) the results of using the Service will meet your requirements.

8. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, in no event shall RecDek Ltd, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorised access, use, or alteration of your transmissions or content

9. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless RecDek Ltd and its directors, officers, employees, agents, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from:

  • Your use of and access to the Service
  • Your violation of these Terms
  • Your violation of any third-party right, including any intellectual property or privacy right
  • Any claim that your User Content caused damage to a third party

10. TERMINATION

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will cease immediately. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

11. GOVERNING LAW

These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. CHANGES TO TERMS

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorised to use the Service.
